Terms of Service
1. Who we are and what this is
Spelling Game is an educational spelling practice service operated at spelling.live (the "Service"). These Terms govern your access to and use of the Service, including any associated mobile applications. By creating an account or using the Service, you agree to these Terms.
2. Who can use the Service
The Service is intended for use by parents and guardians (aged 18 or over) on behalf of children in their care. You must be at least 18 years old to create an account. Child profiles must be created and managed by a parent or guardian. Children must not register for their own accounts independently.
By creating an account, you confirm that you are 18 or over and that you are the parent or legal guardian of any child profiles you create.
3. Your account
You are responsible for keeping your login credentials secure and for all activity that occurs under your account. If you share access with a child (for example, to allow them to log in on their own device), you remain responsible for how the account is used. Please notify us at support@spelling.live if you believe your account has been compromised.
4. What the Service provides
Spelling Game provides tools to help children practise spelling, including word lists, multiple-choice exercises, handwriting input, voice input, and AI-assisted hints and feedback. The Service is for personal, non-commercial educational use only.
We do not guarantee any specific educational outcomes. The Service is a practice tool and is not a replacement for school instruction or professional educational assessment.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation
- Attempt to reverse engineer, copy, or redistribute any part of the Service
- Use automated tools to access or scrape the Service
- Upload content that is harmful, offensive, or inappropriate for children
- Attempt to gain unauthorised access to any part of the Service or its infrastructure
6. AI-assisted features
Some features (such as hints, feedback, example sentences, and handwriting analysis) are powered by third-party AI providers including OpenAI. Content generated by AI is provided for educational assistance only. We do not guarantee its accuracy. Your inputs to these features are processed in accordance with our Privacy Policy and are not used to train AI models.
7. Content you provide
You retain ownership of any content you submit (such as custom word lists or uploaded images). By submitting content, you grant us a limited licence to process and store it solely for the purpose of providing the Service to you. We do not claim ownership of your content and do not share it with third parties except as described in our Privacy Policy.
8. Subscriptions and payments
Some features may require a paid subscription. Where applicable, subscription terms, pricing, and renewal conditions will be presented clearly before purchase. Payments are processed by Apple App Store, Google Play, or other third-party payment providers, subject to their terms. We do not store payment card details.
Refunds are subject to the policies of the applicable app store or payment provider. If you believe you have been charged in error, contact us at support@spelling.live.
9. Availability and changes
We aim to keep the Service available but do not guarantee uninterrupted access. We may update, change, or discontinue features at any time. Where we make material changes that affect your use, we will provide reasonable notice where practicable.
10. Intellectual property
All content, design, code, and trademarks in the Service are owned by or licensed to us. Nothing in these Terms grants you any rights to use our brand, logo, or intellectual property beyond what is necessary to use the Service as intended.
11. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be error-free or uninterrupted.
12. Limitation of liability
To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of or inability to use the Service. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or £50 if you have not made any payment.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
13. Account deletion and termination
You may delete your account at any time from within the app. We may suspend or terminate access if we reasonably believe you have breached these Terms, with or without notice depending on the severity of the breach. On termination, your right to use the Service ceases immediately. Data deletion following termination is handled in accordance with our Privacy Policy.
14. Governing law and disputes
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless mandatory consumer protection laws in your country require otherwise.
15. Changes to these Terms
We may update these Terms from time to time. We will update the "Last updated" date above and, for material changes, may provide additional notice via the app or website. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
